It’s a nonprofit or government agency that makes accessible copies of Works, and limits distribution of those copies to people with bona fide disabilities, the “Beneficiary Persons,” defined in the next article. This is satisfied by having a law like the Chafee Amendment in the U.S., It doesn’t cover movies. Article 2(c).

It is narrower than the Treaty, and is not binding as a treaty would be (some call it “soft law” compared to the “hard law” of a treaty).

Commercial Availability: The Poison Pill for Marrakesh Treaty Implementation

Government funding is slim, and not available in most of the world. And we’re now making this happen in countries beyond the United States who, like India, have implemented Marrakesh without commercial limitation provisions. We now have volunteers throughout India adding local language titles such as Tamil into Bookshare.
