I believe it is a combination of copyright exceptions and business model innovations. For the content of books, this flexibility is expressed in ideas like public domain, when the copyright owned by the author or publisher ends at some point. Remember how crucial the Section 121 copyright exception was to creating Bookshare?

In general, we have patents and copyrights and trade secrets as commercial objects because we as a society think that it helps bring the benefits of new creations to everyone. Universities and government labs encouraging their technology transfer offices to make social licenses of new technology.

This is a musing on the current state of the Gnu Public License, which governs a preponderance of open-source software projects. I know a lot of people in the in the non-profit community think of Open-Source software as "free", as not requiring a license agreement. But the GPL very much reflects US copyright law.
