The Section 121 copyright exception (often known as the Chafee Amendment after the Senator who introduced it in 1996) makes it possible for Benetech to scan just about any book and make it available to this community. The publishing industry and disability organizations both agreed on this provision of copyright law.

Embracing measured risk, The Fund has been willing to make early bets on Benetech, and has repeatedly chosen to invest in our prototype projects.

Today, we are poised at a moment in time where we can transcend the limitations of past book technologies and bring the power of books to all humans. However, as a technology, printed books come with serious challenges for some communities (like blind people) that technology can unlock. Love of the print book. We can do better!

This is the field where I found my life’s calling, applying technology to meet critical needs of society, where the market is likely to fail. And when the idea of a peer-to-peer ebook library came to me, it was George who I went to with the idea. That treaty should replicate the successful copyright exception here in the U.S.

Bookshare is dramatically exceeding its five-year collection and member targets at the close of the fourth year of our Bookshare for Education (B4E) project funded by the U.S. Exciting new tools, including a free, open source Android ebook reader and a free web-based ebook reader along with an accessible bookshelf in “the cloud.”

That’s the lobbying position of some companies in the intellectual property field when implementing the new Marrakesh Copyright Treaty. Our experience successfully building Bookshare under the United States copyright exception, which has no such commercial availability limitation, informs this strong opinion.

Bookshare’s role was mixed: we didn’t end up attending many of these meetings and critiqued early efforts that were crippled by heavy-handed publisher influence, although we did propose at one point to supply technology to TIGAR based on Bookshare. So, in the meanwhile, we will need to rely on licenses: permissions agreements.
